The Nature of Service
Algo-Deck Inc. provides specialized automated trading software (the "EA"). The Client acknowledges that Algo-Deck Inc. is a technology provider, not a financial advisor, broker, or fiduciary. All trading decisions made by the EA are executed on the Client's own account and at the Client's own risk.
Fee Structure
By utilizing our services, the Client agrees to the following non-refundable fees:
- Maintenance Fee: A one-time charge of 2% of the initial deposit for account setup.
- VPS Fee: A recurring monthly fee of $15 USD for dedicated server hosting.
- Performance Fee: Algo-Deck Inc. is entitled to 25% to 30% of all profits generated. For PAMM/MAM accounts, this is deducted automatically by the broker. For individual accounts, the Client must remit this fee immediately following a withdrawal.
Security, Credentials, and Financial Liability
- Provision of Credentials: To deploy and maintain the EA, the Client must provide their MetaTrader 5 (MT5) Master Password.
- Non-Liability for Fund Transfers: Algo-Deck Inc. uses these credentials strictly for technical deployment. The Client acknowledges that Algo-Deck Inc. has no authority over, and shall not be held liable for, any fraudulent transfers, unauthorized withdrawals, or missing funds from the MT5 account.
- Client Safeguards: It is the Client's responsibility to ensure their broker's withdrawal security (e.g., Two-Factor Authentication, Email Verification) is active. Algo-Deck Inc. will never request your broker's portal password or withdrawal PIN.
Absolute Limitation of Liability (The "Litigation Shield")
Algo-Deck Inc. shall not be held liable for any financial loss, whether partial or total.
- No Compensation: We will not bear or compensate for any losses resulting from market volatility or broker insolvency.
- Technical Failures: No liability is assumed for losses caused by EA glitches, coding errors, VPS downtime, or connectivity issues.
- Liability Cap: To the maximum extent permitted by law, our total liability for any claim shall not exceed the sum of the Maintenance and VPS fees paid by the Client in the previous 90 days.
Mandatory Arbitration & Class Action Waiver
Any disputes must be resolved through private binding arbitration in our home jurisdiction. The Client explicitly waives the right to a jury trial or to participate in any class-action litigation against Algo-Deck Inc.
Important Notice: By accessing Algo-Deck Inc. services, creating an account, or paying any fee, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions in their entirety.
